A withdrawal of an infringement action may be allowed with the defendants’ consent where the judge-rapporteur sees no reason not to allow it.

The regular reimbursement rate is 50% when an infringement action is withdrawn before closure of the written procedure.

The regular 50% reimbursement rate may be reduced under exceptional circumstances after the judge-rapporteur takes all circumstances of the individual case into account and weighs the interests involved.

A separate cost decision is unnecessary where the parties unanimously declare that no such decision is needed.

In the absence of better information, the amount in dispute may be set at the undisputed amount stated in the statement of claim as the value in dispute per patent.
